Participant Cancellations and Refunds

Unless different terms are clearly stated for a particular event, a participant may request cancellation and an otherwise available refund before the event begins or during its initial portion.

Once twenty-five percent (25%) of the scheduled event time or planned substantive program content has been presented, delivered, made available, or otherwise provided, the event is considered substantially commenced and no participant refund will ordinarily be available.

This recognizes that value may already have been received through presentations, instruction, materials, discussions, exercises, access to intellectual property, or other event content that cannot meaningfully be returned after it has been provided.

For an event consisting of multiple sessions, modules, days, or portions, the 25% threshold may be measured against the overall program or substantive content purchased rather than an individual session.

Any refund or cancellation right required by applicable law will be honored regardless of this general policy.

Failure to attend, late arrival, voluntary early departure after the applicable refund period, or failure to access available virtual programming does not ordinarily create a right to a refund.

Event Changes

Reasonable changes may be made to an event’s schedule, location, format, technology platform, presentation order, content sequence, or other operational details when circumstances require.

When reasonable under the circumstances, a live event may be converted to a virtual, hybrid, recorded, rescheduled, or comparable format.

Material changes will be communicated when reasonably practicable.

13. Public Speaking and Professional Appearances

Debbi Blessings may accept engagements for:

  • keynote or public speaking;
  • presentations;
  • panels;
  • workshops;
  • facilitation;
  • interviews;
  • educational programs;
  • community events;
  • private events;
  • virtual appearances;
  • media appearances; or
  • other professional engagements.

Every reasonable effort will be made to honor a confirmed speaking engagement and perform as agreed.

Individual speaking engagements may also be governed by a speaker agreement, proposal, engagement letter, contract, statement of work, or other written agreement.

When a separate agreement exists, its specific terms control over these general Terms to the extent of any conflict.

Force Majeure and Circumstances Beyond Reasonable Control

Occasionally an event may be delayed, changed, interrupted, or made impossible by circumstances beyond reasonable control.

These may include severe weather, natural disaster, fire, flood, public-health emergency, sudden illness or injury, medical emergency, death or serious family emergency, transportation cancellation or interruption, governmental action, civil disturbance, war, terrorism, labor disruption, widespread utility or technology failure, venue closure, or another extraordinary circumstance making performance impossible, unsafe, unlawful, or commercially impracticable.

These circumstances are sometimes called force majeure events.

When reasonably possible, the first effort will be to preserve the engagement by rescheduling, changing formats, arranging a remote appearance, or developing another mutually reasonable solution.

Cancellation by Debbi Blessings

If Debbi Blessings must cancel or materially curtail a confirmed speaking engagement because performance becomes impossible or unreasonable, notice will be provided as soon as reasonably practicable when notice is possible.

Amounts paid for professional services that cannot be provided will be refunded to the extent required by the applicable agreement and law.

Documented travel, lodging, transportation, reservation, venue, production, or other third-party costs reasonably incurred specifically for the engagement and that cannot be recovered or refunded may be deducted from amounts otherwise refundable when permitted by the applicable agreement and law.

If part of an agreed presentation or event has already been provided, the refundable amount may reasonably reflect the portion actually delivered, subject to the governing agreement and applicable law.

14. Photographs, Recordings, and Media at Events

Some events may be photographed, filmed, recorded, streamed, or otherwise documented.

When an event involves such recording, appropriate notice, releases, venue terms, or event-specific permissions may apply.

Nothing in these general Terms alone is intended to create an unrestricted right to commercially exploit an identifiable attendee’s image where separate permission is legally required.

Participants may not independently record, reproduce, stream, or distribute a presentation where recording has been prohibited or where doing so would infringe protected rights.

15. User Communications and Submissions

You retain ownership of original material you submit unless another written agreement states otherwise.

Sending an email, message, idea, manuscript, photograph, story, proposal, or other material does not automatically create a confidential, fiduciary, publishing, agency, employment, or contractual relationship.

Unless submissions are expressly invited, there is no obligation to review, preserve, return, publish, compensate, or respond to unsolicited creative materials.

When submissions are invited for a particular project, separate submission terms may apply.

16. Reviews and Feedback

If an order cannot be shipped within the promised period or within another period required by applicable law, the purchaser will receive any notice, opportunity to consent to delay, cancellation option, or refund required by law.

Delivery after shipment may be affected by carriers, weather, transportation interruptions, governmental action, disasters, labor disruptions, seasonal demand, or other circumstances outside our direct control.

Depending upon the circumstances, we may:

  • replace the shipment;

  • provide another reasonable solution; or
  • issue a refund when appropriate or legally required.

A carrier’s “delivered” status may be considered as evidence of delivery but is not necessarily treated as conclusive when credible information indicates a genuine delivery problem.

12. Returns of Standard Physical Products

Unless a different policy is stated with the product, standard unused physical merchandise purchased directly from us may be eligible for return when a return is requested within 30 days after delivery.

A returned product should ordinarily be received in substantially the condition in which it was sold and suitable for resale.

Original shipping charges and return shipping costs may be nonrefundable unless the return results from our error, a verified defect, or applicable law provides otherwise.

Products that have been materially used, altered, damaged after delivery, personalized, customized, or otherwise made unsuitable for resale may not be eligible for a discretionary return.

13. Personalized and Custom Products

Products created, printed, inscribed, personalized, customized, or manufactured specifically for a purchaser or recipient are ordinarily final sale once production has begun.

These may include:

  • personalized books;
  • custom inscriptions;
  • individually prepared journals;
  • custom artwork;
  • made-to-order materials;
  • individually prepared electronic files;
  • custom bundles; and
  • other products materially created or altered for a particular purchaser.

If we make an error in customization or the product is materially defective, we will work in good faith to correct, replace, refund, or otherwise appropriately resolve the issue.

14. Digital and Downloadable Products

Digital products may include ebooks, files, worksheets, printables, electronic journals, recordings, audio, video, streamed materials, online resources, or other electronically delivered content.

Unless otherwise stated, purchase provides a limited license for the authorized use of the content and does not transfer copyright.

Because digital content may be copied, accessed, downloaded, streamed, opened, or otherwise consumed immediately, a digital purchase ordinarily becomes nonrefundable once usable access has been provided.

Reasonable efforts will nevertheless be made to resolve:

  • duplicate charges;
  • corrupted or unusable files;
  • failed delivery;

  • material technical defects within our control; or

16. Events, Programs, Workshops, and Live Experiences

Event, workshop, program, retreat, presentation, or similar purchases are also subject to the Events provisions in the DebbiBlessings.com Terms of Use and any event-specific terms disclosed with the purchase.

Unless different terms are clearly stated for a particular event, a participant may request an otherwise available refund before the event begins or during its initial portion.

Once twenty-five percent (25%) of the scheduled event time or planned substantive program content has been presented, delivered, made available, or otherwise provided, no participant refund will ordinarily be available.

For a multi-session, multi-module, or multi-day program, the 25% threshold may be measured against the overall program purchased rather than an individual session.

Refund or cancellation rights required by applicable law will always be honored.

17. Nonattendance and Participant Changes

Failure to attend, late arrival, voluntary early departure after the applicable refund period, or failure to access available virtual content does not ordinarily create a right to a refund.

When reasonably possible, registration may be transferred to another eligible participant if permitted by the specific event terms.

Event-specific transfer restrictions may apply.

18. Event Changes or Cancellation by Us

Every reasonable effort will be made to deliver an event or program as represented.

When circumstances require, we may reasonably attempt to preserve the event by:

  • rescheduling;
  • relocating;
  • changing presentation order;
  • adjusting timing;
  • converting an event to virtual or hybrid delivery;
  • providing a recorded or alternative presentation;
  • replacing a component with reasonably comparable programming; or
  • reaching another mutually reasonable solution.

Material changes will be communicated when reasonably practicable.

If the purchased event or service ultimately cannot be provided, refundable amounts will be determined under these Conditions, the Terms of Use, any applicable event agreement, and applicable law.

19. Public Speaking and Professional Engagements

Public-speaking engagements and professional appearances may be governed by a separate:

  • proposal;
  • speaker agreement;
  • engagement letter;
  • contract;
  • invoice;
  • statement of work; or
  • written confirmation.

A speaking engagement may require an agreement, deposit, travel arrangements, or other booking conditions before it is considered fully confirmed.

Specific provisions may address:

  • fees and deposits;
  • program duration;
  • travel and lodging;
  • transportation;
  • audiovisual requirements;
  • recording rights;
  • cancellation;
  • postponement;
  • rescheduling;
  • force majeure;
  • intellectual-property use; and
  • payment schedules.

When a specific written engagement agreement conflicts with these general Conditions, the specific agreement controls for that engagement.

20. Force Majeure and Unforeseeable Events

Every reasonable attempt will be made to honor confirmed commitments.

Occasionally, illness, injury, medical or family emergency, severe weather, natural disaster, fire, transportation interruption, venue closure, governmental action, public-health emergency, civil disturbance, widespread utility or technology failure, or another extraordinary circumstance outside reasonable control may make performance impossible, unsafe, unlawful, or commercially impracticable.

When reasonably possible, the first goal will be to preserve the engagement through rescheduling, remote participation, another format, or another mutually reasonable solution.

If Debbi Blessings must cancel and the service cannot reasonably be rescheduled or otherwise provided, the refundable portion of amounts paid will be returned in accordance with the governing agreement and applicable law.

Documented travel, lodging, transportation, reservation, production, or other third-party costs reasonably incurred specifically for the engagement and that cannot be recovered or refunded may be deducted from amounts otherwise refundable when permitted by the governing agreement and applicable law.

21. Preorders

Products may occasionally be offered before anticipated publication, manufacture, release, or delivery.

A stated preorder release or delivery date is an anticipated date unless expressly guaranteed.

If a material delay occurs, purchasers will receive the options required by applicable law.

If a preorder is canceled by us and cannot be fulfilled, amounts paid for the unfulfilled product will be refunded.

22. Bundles

Products and services may be sold together as bundles.

If only part of a bundle is eligible for return or refund, the refund may be calculated according to the regular, stated, or reasonably allocated value of the items or services retained rather than by evenly dividing the bundle price.

Digital, personalized, consumed, event-based, or otherwise nonreturnable components may affect refund eligibility.

23. Gift Purchases

Where gift purchases are available, purchasers are responsible for providing accurate recipient information.

Refunds ordinarily return to the original payment method when reasonably possible.

29. Right to Decline Future Transactions

Service will not be refused for an unlawful discriminatory reason.

30. Intellectual Property

Purchasing a product does not transfer copyright, trademark rights, publication rights, or other intellectual-property ownership.

35. Severability and No Waiver

If any provision is determined to be unlawful or unenforceable, it may be limited or severed to the minimum extent necessary while the remaining provisions continue in effect where legally permissible.

Failure to enforce a provision on one occasion does not automatically waive the ability to enforce it later.
